Forced Labor restrictions discussed
JFK Customs and Border
Protection (CBP) holds these
quarterly meetings targeted to
the Brokers and freight forwarders.
There can be a great deal
of detail on processes, compliance
and names of people in the
agencies that interact with CBP
that are good resources for all
Customs related matters.
Deputy Director Andrew
Renna said that this stakeholder
engagement is important to CBP
for the greater JFK community.
He announced the preciously
changes leadership with Frank
Russo as the new DFO for JFK
and EWR, Sal Ingrassia as new
JFK Port Director and Joseph
Rollo Cargo Division Chief
In terms of statistics Renna
reported that is was a strong fiscal
2021 (just ending)) with $118
million entries signifying a 200%
increase over 2020, The bulk
was due to Section 321 entries
which they are monitoring to be
sure requirements are met.
Renna said that CBP is monitoring
these entries. They are
giving good latitude but will be
aggressive for those not in compliance.
Forced Labor
There is renewed focus on
Forced Labor and restrictions
on importing goods suspected of
being manufactured by children
or indentured servants or other
similar oppressed people.
This is not a new law but
appears to become a priority
issue in the future but important
as the agency began
enforcing it last year when
agency took a strong stand
with new processes and procedures.
Some entries are being
held because of forced labor
that comes to light based
on allegations from those involved
with manufacture or
shipment. Allegations become
investigations and if found
then issued a WRO (withhold
release order) which directs
CBP to withhold entries that
fit the description of the allegation.
A recent example was the
case involving rubber gloves
that was a finding and seizures
of those products. In fiscal 2021
there were 696 shipments detained.
Forced labor is part of the
larger picture of human rights of
which human trafficking is also
related in which the CBP runs its
BLUE Campaign.
FDA
The FDA gave an update on
ACE Automatic Rescind Messaging,
The spokeswoman said
that Periodically FDA issues
these but the Rescind Messaging
is limited used on a limited
basis..
CPSC
Debbie Bonardi of CPSC
spoke about ecommerce, their
products, and the need for compliance
and understanding the
proper documentation to avoid
any problems with shipments.
