HORSING AROUND
Q: At a horse farm, I was taking horseback riding lessons. My
instructor told me to perform a certain maneuver with my feet out of the
stirrups. I felt uncomfortable performing it and told him so and that it
was beyond me, but he insisted. So I struggled to control the horse and to
execute the maneuver. In attempting to complete it, I fell off the horse.
A: The defendants are likely to argue that your lawsuit is barred by
the theory of ‘primary assumption of risk’. That is, a voluntary participant
in a sporting or recreational activity consents to those commonly
appreciated risks that are inherent in, and arise out of, the nature of the
sport generally and flow from such participation. Their attorney will

Here, the conditions were unique and created a dangerous condition
over and above the usual dangers that are inherent in the sport. The
instructor’s conduct unreasonably increased your exposure to the risk of
falling.
