at JFK Airport
Pick-up area road rage or hate crime?
A man verbally and physically assaulted
a yellow cab driver at JFK over
a week ago. After aninvestigation, Mohamed
Hassanain was arrested. He
had shouted “go back to your country”
and called the taxi driver (identified
only as Mr Singh to preserve his anonymity)
“turbaned people” in a derogatory
manner while repeatedly punching
and shoving him, leading the police

to consider the incident a hate crime.
Hassanain is being charged with assault
in the third degree as a hate
crime, assault in the third degree, and
aggravated harassment in the second
degree, and will be arraigned.
In a video gone viral, it seems that
road rage struck the man who assaulted
a taxi driver outside a terminal
at a JFK Airport pick-up area.

JFK when severe weather is forecast.
JFKEOC will activate levels of
preparedness based on inclement
weather reports. Level 2 and above requires
participation from Port Authority
departments only. When the the EOC
increases activation to a Level 2 Airport
stakeholder virtual participation is
required.

Biden sets legislation
against Xinjiang
Forced labor imports to be detained
President Biden signed into law on
December 23 legislation that will, for
the first time, require U.S. Customs
and Border Protection (“CBP”) to detain
all imports that are made wholly or
partly in the Xinjiang Uyghur Autonomous
Region of China (“Xinjiang”) or
by certain persons working with Xinjiang’s
regional government. On December
14, the U.S. House of Representatives
passed the Uyghur Forced
Labor Prevention Act (“UFLPA”) (H.R.
6256) unanimously, and then the Senate
also unanimously approved the
UFLPA on December 16. Given that
rare unanimous bipartisan support for
the UFLPA, we expect the Biden Administration
will now aggressively implement
the UFLPA by increasing CBP
enforcement against imports believed
to have a nexus with Xinjiang. We propose
steps below that both Chinese
and U.S. companies can take to reduce
the likelihood of such UFLPA disruptions
in their supply chains.
Pre-UFLPA Law and Forced Labor
Even before the enactment of the
UFLPA, foreign-source imports made
with forced, prison or child labor had
already been subject to detention and
potential seizure by CBP under Section
307 of the Tariff Act of 1930 (“Section
307”). To implement Section 307,
CBP issued Withhold Release Orders
(“WROs”) that would instruct CBP officers
to detain specified classes of
products from specific companies or
geographic regions because of alleged
involvement of forced, convict or child
labor.
Actual passenger violence against
others is more likely than catching covid
at the airport. Three Long Island
women were arrested and indicted for
assaulting a Delta Airlines security officer
and gate agent at JFK Airport. The
Security guard was struck with his own
radio, punched in the face and kicked
by defendants who were asked to leave
the jetway because they appeared
drink and would not wear masks.
An indictment was unsealed recently
in federal court in Brooklyn
charging Jordan Nixon, Janessa Torres
and Johara Zavala with assaulting
an airline security officer and another
enroute to Puerto Rico on September
22, 2021.
“The FBI is the lead federal agency
in charge of arresting those who assault,
intimidate, or threaten flight crew,
or endanger the safety of other passengers,”
stated FBI Assistant Director
in-Charge Driscoll. We are aggressively
addressing this emerging threat
and take all cases seriously.”
