TOWERS Restaurant at North Shore Towers VISITING THE This past week, the Special Projects Committee sponsored a trip to the 9/11 Museum. It seemed to us a natural follow-up to our September program that hosted a capacity crowd in our newly furbished movie theater. The 50 attendees boarded the bus after a light breakfast in our restaurant. We learned immediately that the trip to the new World Trade Center was very time consuming. Parking in the area required all of us to walk several blocks after a 2-hour bus ride. HINT: If you visit, take public transportation! The Museum itself was a masterful accomplishment. It’s a huge building and anyone who attends should avail themselves of a guided tour. The guides are extremely knowledgeable and each person is given “headsets” in order to hear the expert description of all of the emotionally charged exhibits. It’s difficult to describe the impact of the experience. We’ve all lived through the horrendous day, and unfortunately many of us have lost friends and/or relatives. On one hand, it’s beautiful, and on other, it’s a rather somber experience. To most of us, there was the feeling that we all owed those who perished an obligation to visit what we called “hallowed ground.” One exhibit was particularly interesting: a huge wall with covered many sheets of paper, all in different shades of blue. The guide explained to us that each sheet was dedicated to the memory of one of the 2,977 people who died on September 11. Sadder still was the fact that the museum housed the remains of more than 400 people who have yet to be identified. The laboratory is utilizing DNA evidence in an attempt to discover their identity and inform the grieving family members. On our return home, one of our residents was missing. Linda’s significant other Ed was a former special serviceman. He was firm in his belief that we leave no person behind. According to the police report, DJ said he lost control when he saw an old friend. Nowadays, he is making out that, all of a sudden, an oncoming car crossed over the double yellow line: that’s why he swerved to the right. A: Using the latest story, DJ’s attorney may argue that his client was faced with an emergency, that his actions are reasonable and prudent in that context. Suddenly faced with an unexpected circumstance, not of his own making, DJ had little or no time to reflect and was compelled to make a quick decision without weighing alternate courses of conduct. Your attorney will reply that DJ’s latest explanation, about an oncoming car, is so patently a recent fabrication that it should not even get to the jury – even though resolving questions of credibility, assessing the accuracy of witnesses, and reconciling conflicting statements are generally entrusted to a jury. With regard to the police accident report, you will need to authenticate it, and sometimes may even want to take the deposition of the police officer who prepared it. Presumably, the officer was acting within the scope of his duty in recording DJ’s statement: it ought to be admissible as a party admission. To prevail against the rental-car company, you need evidence that the accident was caused by equipment failure or that the company was negligent in entrusting the vehicle to this customer. To prevail against the web site, you would need to voyage successfully through largely uncharted legal territory, with far more facts than you have given here.
