He founded the Hunters Point Civic Association, which advocates for neighborhood causes, brings awareness of issues to the community and works to get community feedback. About two years ago, O’Leary became one of the founding members of the Boys and Girls Club’s Sunnyside/ Woodside unit, which provides activities including sports, artistic and educational events for children. O’Leary also works as a legal compliance council for Bloomberg L.P. BACKGROUN D: O’Leary was born in Jackson Heights and currently lives in Long Island City. He spent 10 years in Japan working for Bloomberg and was a former City Council candidate for District 26. FAVORI TE MEMOR Y: “My favorite memory is receiving a thank-you letter from all of the kids of the Boys and Girls Club,” said O’Leary. BIGGES T CHALLEN GE: “The biggest challenge has been trying to get people involved,” he said. “Because people are very busy with work and life, it’s hard for them to devote time to other causes.” However, O’Leary is very happy with the Hunters Point Civic Association, which hosts active monthly meetings. INS PIR ATION : “My inspiration is my parents and seeing how hard they worked to make sure I had a chance,” O’Leary recalled. “That makes me want to make sure everyone else has the same chance, an opportunity to follow their dreams, whatever they may be.” BY MELISSA FERRARI Legally Speaking By: Scott Baron, Attorney at Law READ AND WRITE Q: Last fall, in order to insure our home, we decided to get a homeowner’s policy. Speaking to our broker, we specifically requested a million dollars of coverage. I have to confess that we never read this policy. It turns out that our liability limit was only 300 thousand. The following summer, a fire broke out. Both our broker and the adjuster made a detailed inspection of the damage. Afterwards, we thought that the adjuster had authorized us to demolish what was left, and we did. A: Generally, a broker has a duty either to obtain the coverage you request or to inform you that she cannot. To the extent that you can give testimony or have other proof of a specific request, your failure to read the terms of this policy, despite your ample time to do so, is not necessarily fatal to your case. Under the doctrine of spoliation of evidence, one who destroys evidence can be penalized to the extent that the destruction was willful, the lost evidence was central, and your opponent was set back in his ability to make a case. Sounds like no penalties are warranted here: your insurer carried-out a detailed inspection, and you have an honest recollection that the adjuster authorized a demolition.
