Notice of Opportunity for Public Comment on Extension of the Deadline to Submit a
Use Application for Passenger Facility Charges (PFCs) at EWR, LGA, JFK and SWF
The Port Authority of New York and New Jersey (Port Authority) hereby provides an opportunity for public comment
on the extension of the deadline to submit an application to the Federal Aviation Administration (FAA) to use PFCs.
Four projects were previously approved by FAA for impose authority on January 21, 2018:
�� LGA Terminal B Airside Pavement Reconfiguration
�� EWR Terminal A Terminal Construction
�� EWR Terminal A Airside Pavement & Infrastructure Construction
�� EWR Terminal A Airport Roads Construction
The projects are currently under construction. Total PFC revenue for these projects is $825,000,000.
Under FAA regulations, a corresponding use application should be submitted within 3 years of the approval of impose
authority. FAA can approve an extension of this deadline after an opportunity for public comment. The Port Authority
intends to request an extension of the deadline to submit a use application to January 21, 2023.
The Port Authority has prepared a draft of the use application. However, the use application cannot be submitted to FAA
until other ongoing, not directly related, issues are resolved. The Port Authority intends to submit the application promptly
once these issues are resolved.
Interested parties may provide written comments to the Port Authority within 30 days of publication of this notice.
