EARLY NOTICE OF A PROPOSED ACTIVITY
IN A 100-YEAR FLOODPLAIN AND WETLANDS
SUNSET COVE PARK MARSH RESTORATION PROJECT
QUEENS COUNTY, NEW YORK
March 8, 2019
To: All interested Agencies, Groups, and Individuals
This is to give notice that the Governors Office of Storm Recovery (GOSR), an office of the New York State
Housing Trust Fund Corporation (HTFC), has received an application from the Town of Olive to use Community
Development Block Grant – Disaster Recovery (CDBG-DR) funding from the NY Rising Community
Reconstruction Program to implement the proposed Sunset Cove Park Marsh Restoration Project in Queens
County, New York (hereinafter, the “Proposed Activity”) and is conducting an evaluation as required by Executive
Order 11988 and Executive Order 11990 in accordance with U.S. Department of Housing and Urban
Development (HUD) regulations (24 CFR Part 55).
There are three primary purposes for this notice. First, to provide the public an opportunity to express their
concerns and share information about the Proposed Activity, including alternative locations outside of the
floodplain and wetlands. Second, adequate public notice is an important public education tool. The dissemination
of information about floodplains and wetlands facilitates and enhances governmental efforts to reduce the
risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness,
when the government determines it will participate in actions taking place in floodplains or wetlands, it must
inform those who may be put at greater or continued risk. Funding for the Proposed Activity will be provided
by the HUD CDBG-DR program for storm recovery activities in New York State.
The Proposed Activity is part of a restoration and resiliency project that will provide a nature-based approach to
coastal protection, including wave attenuation. The project will provide a measure of protection for planned habitat
improvements, publicly-owned recreational facilities, homes, businesses, and other surrounding existing assets
from wave impacts during storms and shoreline erosion. The surge from Superstorm Sandy covered the Broad
Channel community and damaged homes, businesses, and natural resources. The Proposed Activity would
provide waterfront access for nature-based environmental education in an area that is currently inaccessible to
the public and promote stewardship and social resiliency through partnership with local organizations and
community-led volunteer events.
The Proposed Activity is located on Sunset Cove Park, which is an abandoned and deteriorated marina
surrounded by the Broad Channel residential community. The shoreline of the project area, and Big Egg Marsh
to the southwest, are both part of the National Park Service (NPS) Jamaica Bay Wildlife Refuge and the Gateway
National Recreation Area.
The Proposed Activity entails the construction of a viewing platform area above Sunset Cove. The boardwalk will
be constructed of wood and extend from an existing walkway, out into restored wetland along a previously
constructed berm that runs along the shoreline. A hexagonal outdoor classroom will be constructed at the end of
the boardwalk. The length of the boardwalk will be approximately 370 feet with a 7-foot width, gradually
increasing in elevation from the ground surface to the classroom.
The Proposed Activity would result in temporary impacts to wetlands during construction. The western edge of
the project area borders a National Wetlands Inventory (NWI) Estuarine and Marine Deepwater wetland
associated with Broad Channel. Approximately, 5.24 acres of the project are within NYS tidal coastal wetlands,
and approximately 5.29 acres are within the 300-foot buffer. All necessary precautions would be undertaken to
prevent contamination of any streams, channels or waterways by silt, sediment, fuel, solvents, lubricants, epoxy
coatings, debris, concrete leachate, or any other pollutant associated with Project construction. Once construction
is completed, the function of the wetlands would remain unaltered by the Proposed Activity.
The Proposed Activity would result in temporary impacts to the 100-year floodplain during construction. The
majority of the 12-acre project site is located within Special Flood Hazard Area (SFHA) Zone AE (areas within
the one percent annual chance of flood), and a small portion of the northwestern Project Site area is within SFHA
Zone VE (areas within the one percent annual chance flood and is also a coastal flood zone with velocity hazard).
The western side of the Project site is within the Limit of Moderate Wave Action. Once construction is completed,
the function of the floodplain would remain unaltered by the Proposed Activity.
Floodplain maps based on the FEMA Base Flood Elevation Maps and wetlands maps based on the NWI and
New York State Department of Environmental Conservation (NYSDEC) data have been prepared and are
available for review with additional information at http://www.stormrecovery.ny.gov/environmental-docs.
Any individual, group, or agency may submit written comments on the Proposed Activity or request further
information by contacting Lori A. Shirley, Certifying Officer, Governors Office of Storm
Recovery, 99 Washington Avenue, Suite 12260, Albany, NY 12260; email:
NYSCDBG_DR_ER@nyshcr.org. Standard office hours are 9:00 AM to 5:00 PM
Monday through Friday. For more information call 518-474-0755. All comments
received by March 25 2019, will be considered.
