 information, you can request to file an amended police report at the precinct. It is  
 up to the discretion of the officer who took the report whether they will allow any  
 changes.   
 If  you  are  not  able  to  amend  the  police  accident  report,  you  will  have  the  
 opportunity  to  describe  your  version  of  the  accident  in  a  document  called  an  
 MV-104. This is a form that must be filed with the DMV within ten days of the  
 accident  if  the  accident  resulted  in  any  injuries,  fatalities,  or  property  damage  
 exceeding $1,000. Prior to filling out this document, it is best to consult with an  
 attorney as any statements contained in it may be used against you at a later time.     
 Can a Police Accident Report be Used in Court? 
 Under the rules of evidence, “hearsay” is generally not permissible in court, unless  
 it  falls  under  an  exception.  Although  police  accident  reports  are  considered  
 “hearsay,”  they  can  still  be  admitted  into  court  in  New York  State  in  limited  
 circumstances. For example, a police accident report may be admissible under the  
 business record exception to hearsay if it was based upon the officer’s own  
 observations while they were carrying out their duties. The information included in  
 a  police  report  may  also  be  admitted  into  court  if  the  person  who  provided  the  
 statement had a particular duty to report.
