Q: On the ground outside my daughter’s preschool, there was snow and slush. When the
teacher arrived, she placed paper towels on the floor in the cubby area of the classroom and asked the
maintenance staff to provide something stronger. Nothing was ever provided. The teacher needed to
replace the wet paper towels with dry ones as the children and parents arrived in the classroom.
Eventually, the teacher observed snow being tracked into the classroom and called the maintenance
staff to mop it up. No one came. An hour later, I fell.
A: An owner is not required to provide a constant remedy to the problem of water being
tracked into its building during inclement weather. The owner must merely take reasonable care that
the public not be exposed to danger through conditions in the premises or at the entrance. The owner
is not responsible for injuries caused by water and mud being brought into an entranceway on a rainy
day unless it is shown that the construction of the premises was inherently dangerous or that the
owner failed to use care to remedy conditions which had become dangerous, after actual or
constructive notice of such conditions.
Similarly, a defendant is not strictly obligated to cover all of its floors with mats or
continuously to mop up all moisture resulting from tracked-in precipitation. Nevertheless, a
defendant may be held liable for an injury proximately caused by a dangerous condition created by
water, snow, or ice tracked into a building if the defendant either created the hazardous condition, or
had actual or constructive notice of the condition and a reasonable time to undertake remedial action.
It certainly appears that, an hour before the accident, the school had actual notice of the
wet condition in the area where you fell, but failed to remedy it. Accordingly, you appear to have a
strong argument that the school was negligent in failing to maintain the premises in a reasonably safe
condition, and that its negligence was a substantial factor in causing your accident.
Vantage Medical Group will offer free prostate cancer screening at Northern Boulevard
Radiation Oncology in Flushing on Sunday, February 2 from 2:00PM-6:00PM. The free
screening is part of the Brown Byrd Foundation’s Prostate Cancer Awareness Day, which
aims to raise awareness, encourage early screening, and promote research.
Because survival rates remain high when the cancer is detected early, Vantage hopes
that those at an increased risk will take advantage of this opportunity. Men over the age of
50 face a higher risk of prostate cancer, as do African-American men and those with a
family history of the disease.
The State of New York plans to observe the day by lighting Niagara Falls blue, the color of
prostate cancer awareness. In a statement, New York State Comptroller Thomas P. DiNapoli
stressed the event’s importance.
“Created by two people who lost their grandfathers to the disease, the Brown Byrd
Foundation recognizes the critical importance of early detection and treatment in order to
save lives threatened by prostate cancer,” DiNapoli wrote.
Vantage Medical Group invited community leaders and elected officials to the event in a
letter this week. The group emphasized the valuable role these leaders can play if they
promote and attend the event.
